Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the website, platform, and services provided by Forty Two A - Research and Development Ltd. ("42A," "we," "us," or "our"), a company registered in Israel.
By accessing our website at 42a.ai or using our platform and services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, please do not use the Services.
2. Description of Services
42A provides an AI visibility infrastructure platform that helps brands monitor, analyze, and optimize their positioning within generative AI responses. Our Services include AI brand visibility analytics, buyer prompt intelligence, GEO optimization actions, competitive intelligence, and related tools and reports.
3. Eligibility and Account Access
The Services are intended for business use. By using the Services, you represent that you are at least 18 years of age and have the authority to enter into these Terms on behalf of yourself or the organization you represent. Access to the platform requires a subscription governed by a separate Master Service Agreement ("MSA") and applicable Order Form.
4. Acceptable Use
You agree not to: (a) use the Services for any unlawful purpose or in violation of applicable laws or regulations; (b) attempt to reverse engineer, decompile, or disassemble any part of the platform or its underlying algorithms; (c) copy, modify, distribute, sell, or lease any part of the Services; (d) use automated tools to scrape, crawl, or extract data from the Services beyond what is provided through your authorized account; (e) transmit viruses or other harmful code; (f) interfere with or disrupt the Services or servers; or (g) conduct security testing or benchmarking without our prior written consent.
5. Intellectual Property
All content, features, functionality, software, designs, and materials available through the Services are owned by 42A or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited license to use the Services as authorized.
6. User Content and Feedback
Any data, content, or materials you submit through the Services ("Customer Data") remain your property. By providing feedback or suggestions about the Services, you grant 42A a non-exclusive, perpetual, royalty-free right to use such feedback to improve the platform and Services.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, 42A DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 42A DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THEY WILL IMPROVE YOUR BRAND VISIBILITY OR BUSINESS OUTCOMES.
The Services incorporate artificial intelligence and machine learning technologies. 42A makes no warranties or representations about the accuracy, reliability, or effectiveness of AI and machine learning components incorporated into the Services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 42A SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. 42A'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
9. Indemnification
You agree to indemnify, defend, and hold harmless 42A from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
10. Term and Termination
These Terms apply for as long as you access or use the Services. We may suspend or terminate your access at any time for violation of these Terms. Subscription terms, including renewal and termination provisions, are governed by the applicable MSA and Order Form.
11. Governing Law and Jurisdiction
These Terms are governed by and construed under the laws of the State of Israel. The competent courts of Tel Aviv shall have exclusive jurisdiction with respect to any dispute arising under or in relation to these Terms.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
Refund Policy
1. 30-Day Money-Back Guarantee
If you are not satisfied with 42A's Services, you may request a full refund within thirty (30) days of your purchase or subscription start date. To request a refund, contact us at legal@42a.ai within the 30-day period. Refunds will be processed to the original payment method.
2. After the 30-Day Period
After the 30-day refund window has passed, all fees are non-refundable. If you cancel your subscription after this period, you will continue to have access to the Services through the remainder of your current billing period, but no refund will be issued.
3. Free Trials and Assessments
Where 42A offers a free trial, assessment, or evaluation period, your payment method may be collected at registration but will not be charged until the trial ends. No refund applies to free trial periods as no charge is made. If you do not wish to continue after a trial period, you may cancel before the paid subscription begins to avoid being charged.
4. How to Request a Refund
To request a refund, email us at legal@42a.ai with your account details and the reason for your request. We will process eligible refund requests within ten (10) business days.
